On July 11, 2024, a bench of Justices Ahsanuddin Amanullah and Vikram Nath gave an important decision in favor of Mohammad Rahim Ali, who had appealed in the NRC case of Mohammad Rahim Ali alias Abdul Rahim vs the State of Assam, saying that no one can be declared a foreigner on the basis of minor differences in names and dates in the documents issued by the government. In this way, the Supreme Court rejected and disposed off the earlier decision given in the case by the Assam Foreigners Tribunal and Guwahati High Court, and overturned it by declaring that Mohammad Rahim Ali alias Abdul Rahim as “an Indian citizen and not a foreigner”.
It is known to all that there are some minor spelling mistakes or discrepancies in date and gender of people in government documents which mostly happens due to incompetence of government employees, hence as per the order of the Supreme Court “minor differences in name and dates” cannot be the basis to decide who is an Indian and who is a foreigner. Legal experts and lawyers believe that the decision of the Supreme Court of India in that case was historic and it is a milestone in the issues related to NRC which the citizens of India should study thoroughly and keep it safe for future reference in such cases anywhere in India.
